The famous old club is the victim of a major restructuring of the game in Wales, which will see the formation of a new 12-team Premiership.

In a trial in London last month, the club challenged the Welsh Rugby Union's decision, arguing that it was unfair and should be overturned.

But today, after taking a fortnight to come to a decision, the judge, Sir Raymond Jack, returned to the High Court to dismiss the club's claim.

"I conclude that Pontypool has failed to establish any breach of contract or breach of duty on the part of the WRU and that there are no grounds for the intervention of the court," he said.

The club's barrister, Ian Rogers, had argued that, after originally deciding on a 10-team Premiership, the WRU had succumbed to pressure from regional clubs to extend it.

The pressure, from Ospreys and Scarlets, led to a decision - against the rules, he said - to add Carmarthen Quins and Bridgend Ravens to make up a 12-team division.

The WRU said the two clubs were next in line to be added to the Premiership because they came 11th and 12th in a "meritocracy" based on recent on-pitch performance.

Pontypool, described by the judge as having a "proud history", was the 13th in the list and so not in line to be awarded a place in the league, the WRU said.

That was despite it having achieved a so-called A-licence, relating to the quality of its stadium, which was deemed necessary for entry to the Premiership.

Sir Raymond said changing the structure to include 12 teams was against the rules as they stood, but that the WRU has power to change those rules even at a late stage.

"The issue between the WRU and Pontypool here must be whether the late change involved unfairness to Pontypool such that the court should intervene," he continued.

"The answer to that is, in my judgment, plainly that it did not.

"This is because Bridgend and Carmarthen were 11th and 12th in the meritocracy.

"It was not unfair to Pontypool to enlarge the Premiership.

"It was not unfair to enlarge it by adding the next two clubs by meritocracy.

"The fact that they were added because they were Bridgend and Carmarthen does not change that. Pontypool's position was unaffected.

"If Pontypool had been ahead of them, or one of them, by meritocracy, then quite different arguments would have been open.

"It is, however, clear that the decision was to add these two particular clubs."

Mr Rogers asked the judge for permission to appeal, but the request was refused and the WRU was granted permission to get on with plans for the 2012-13 season.

"It has already been put off too long," said WRU barrister, Adam Lewis QC.

"All of the people, the staff, the sponsors, the players, are going to need to know what position they're in.

"Everything has been suspended already for much too long."

Pontypool could now make an application directly to the Court of Appeal for permission to appeal Sir Raymond's decision.

The WRU said they welcomed the High Court decision and union chief, Roger Lewis, added: “We can now all place this issue behind us and move forward in the best interests of Welsh rugby.

"We were disappointed that Pontypool decided to take this legal action against the Union. We cannot achieve change without facing up to difficult decisions. It is important we all now move on in harmony for the sake of the game."

Ebbw Vale has most to complain about the restructuring. If they had not been relegated, and lasted just one more season in the top flight, they would comfortably have been in the top 12 in terms of meritocracy.

Although it’s with sorrow I see Pontypool pushed out by the WRU, I am heartened by the thought of again playing Ebbw and Newbridge. we may not do too well this year due to the loss of players to the top flight whom they judge thinks can’t play but what the heck . The WRU model of two first class sides in one town is doomed to fail, that can be clearly seen by the support Ebbw and Newbridge still have; they are not daunted by the call of “Newpart Newpart” and the supporters of Pontypool should be the same.

It was sad to witness that the grave robbers of Newport had been hard at work digging up bodies from the Pontypool squad even before the 'London' Judge had given his ruling on Pontypool's appeal against the WRU decision.
Maybe we will hear the chant of 'Pooler, Pooler, Pooler' at Rodney Parade this year.

I don't expect the Newport die-hards will shout too loudly about the extra travel and demands on players going to Newport in the way that they have over the NGD travelling to Ystrad Mynach to use the top class facilities at the proposed centre of excellence.

Can anyone remember if Newport were considering membership to the English RU at some time, or is that something that has been twisted in the historical folk law of SE Gwent?

1 - The players had the option to stay with Pontypool. They chose not to and opted to move. Not unusual when a club gets relegated and did anyone really think Pooler would win the case? Reading the judges full comments shows he dismissed the case 100%. They were 13th in the list for 12 places. Fact. Waste of money which could have been spent on getting a really competitive squad together?

2 - Not read any complaints about the proposed move to Ystrad Mynach. Most of my NRFC aquaintances think it makes sense and have no issues with it. As someone who lives near YM, am not 100% certain that this will go ahead anyway - yet.

Anyway, good luck to Pooler next season. I hope they manage to get a competitive squad together as it's a tough division with some decent sides as Ebbw, Bargoed etc have shown.

The saddest thing about this is that it's all top down instead of bottom up. Most of us just want to watch our team play week in week out but Welsh rugby is driven by the national team and the majority of the 75,000 fans (wont call them supporters) at international matches who hardly ever - if ever - go to watch a club match let alone hold a season ticket.

A decent side like Ebbw???????? blimey what have we done to deserve such praise?Could it have anything to do with the fact that we put three grand behind the bars at wonderful clubs as Treorchy,Beddau and Gilfach Goch on match days,whilst you lot have had to put up with Cross Key's magnificent seven supporters.Admit it .you've missed the Ebbw Addicts haven't you.See you soon Pooler welcome back.

A sensible post Cymro57, although I believe many did believe Pooler had a chance to win. The point was not just about placings but on the enforcement of their own rules, or lack thereof!

Agree re the WRU's approach. They are only interested in those who turn up to the M Stadium, most of whom are rugby fans in the loosest sense and not interested in grass roots rugby at all. Without the grass roots the top of the game will diminish over time, as less kids are unthused to watch the game. The whole of Blaenau Gwent, Torfaen and large parts of Monmouthshire are now disenfranchised from the game.

Good luck to the Welsh game, it will need it!

Those Saturday (and Wednesday) games really were something to look forward to both on and off the field.

Yep, nightmare is the word you are looking for! After all that Gwent has done for Welsh rugby over the years, to have the geographical region disemboweled by the WRU in such a way is beyond words. Pontypool and Newport have always been hated by the WRU; maybe because it is border country, who really knows???

In court the wru stated that the reason pontypool were relegated was that they simply wernt good enough on the pitch.Fair enough poor performaces dont deserve reward. However something seems to have by passed Roger lewis + the wru. From dec 2009 to may 2012 Pontypool were coached by wru man James chapron, One of the senior coaching staff of the wru. Under his guidance Pontypool were not good enough for the new top flight. Where is mr chapron now?. He has been promoted to wru Performance Director Dragons region. Now if he manages to keep the dragons in the bottom three, What next? National coach maybe. Bizzare.
