Situation: The land is freehold and is offered for sale by the Executors of Mr J G Haworth.

All three residential properties are currently occupied by Assured Shorthold tenants and the farmland is subject to a grazing licence. Vacant possession will be granted on completion.

Basic Farm Payment - The land is registered with the Rural Payments Agency and has been used to claim under the Basic Payment Scheme.

There are entitlements allocated to the land and these will be transferred to the purchasers on completion subject to the RPA's transfer rules. The monies arising from the 2019 Basic Payment application will be retained by the Vendors and the purchasers will be required to cross comply in respect of the 2019 scheme year.

Environmental Scheme and HLS scheme is currently in place across the whole farm.

Notice has been given to the Rural Payments Agency to terminate the HLS agreement in the Autumn of 2019, although all purchasers of the lots will be required to comply with the terms of the current HLS Agreement until such time as the Rural Payments Agency have made their final inspection. The purchaser of Lot 2 (Yellow 19.567 ha, 48.351 ac) will be required to form a new access off the Council maintained highway to the north of Lot 2 at the point marked X within three months of purchase. This is subject to planning consent currently being sought by the Vendors.

During the first three months, the purchaser of Lot 2 is permitted a temporary right of access over the driveway serving Lot 1.

Lot 2 will have a right of access over the drive to Ritton place included in Lot 3.

Lot 3 (Purple 8.621 ha, 21.302 ac) is subject not only to the right of access for the purchasers of Lot 2 but the owners of Ritton Place which has a right of access over the track running along the northern boundary of Lot 3.

The purchasers of Lot 4 (Blue 19.918 ha, 49.228 ac) will have rights over the right of way running along the eastern boundary of Lot 3.

Lots 2, 3, 4 and 5 all have rights of access over third party land from the Council maintained road adjacent to the Bog visitor centre to the land included in each lot.
