A FATHER-OF-FOUR who confronted revellers outside a nightclub with a baseball bat after his girlfriend had been attacked has escaped an immediate jail sentence.

Pierce Green drove to Newport’s La Bamba to go to her aid after she was on a night out, the city’s crown court heard.

Prosecutor Sarah Waters said the 29-year-old defendant, of Potter Street, Newport, had then punched “a man in a white top”.

This man had used “derogatory terms” against her and pushed her before he was hit by Green outside the busy club on October 7, the court heard.

A large crowd had by now gathered and Green put his partner in his BMW before driving off and stopping almost immediately to go into his boot and pull out the baseball bat, Judge Jeremy Jenkins was told.

The defendant then challenged them with the weapon before he retreated and tried to get back into the car to drive off before he was caught by some of the men involved in the fracas and suffered two black eyes.

Miss Waters said police officers soon arrived and the defendant was arrested.

Judge Jenkins said: “The man in the white top wouldn’t behave himself – the whole incident could have been stopped so easily.”

Green admitted a public order offence, having an offensive weapon, possessing cannabis and being in breach of an earlier community order after a sentence for resisting police officers.

The court heard was sentenced to a three-year jail sentence in 2013 for possessing heroin with intent to supply.

Ben Waters, mitigating, said that “justice had been meted out” to his client after he had suffered two black eyes in the commotion.

He added that Green had made full admissions to the police.

Judge Jenkins said: “Disgraceful though this incident was, there was an element of provocation.

“Your partner was assaulted by a man in a white top – a very aggressive young man.”

He jailed Green for a total of 16 weeks, suspended for 12 months, and ordered him to carry out 100 hours of unpaid work.

The defendant must also pay the prosecution’s £340 costs and a victim surcharge.
