A NEWPORT convenience store could have its licence revoked after selling items later than allowed and smoking taking place in the shop.

Baneswell Express has also been warned about selling psychoactive substances after nitrous oxide charges were found dumped outside the store in Baneswell Road.

An application for a review of the store's licence has been submitted and will be discussed by Newport City Council's licensing sub-committee on Monday, August 6.

Most recently, CCTV recordings appear to show the store breached multiple licence conditions on February 24 this year, according to the application.

These include "premises to close to customers no later than 12 midnight on any day" and "all alcohol to be screened or covered after licensable activities period ends whilst premises remains open to customers".

CCTV is said to show customers buying products from the store as late as 2am, though it cannot be determined if alcohol was purchased.

Premises license holder Arfan Sabir was warned that customers are not allowed to enter the shop after midnight when he was interviewed about the incidents in May.

Gwent Police and Newport City Council's licensing authority also attended the store in May of last year after receiving "comprehensive evidence" the shop was selling psychoactive substance in the form of nitrous oxide, known as laughing gas.

At the time of the visit there were several nitrous oxide charges discarded outside the store, the application says.

The depressant-type drug can cause dizziness and lead to sound distortions and even hallucinations.

Although nitrous oxide is sold an aerosol spray and has uses in medicine, it is illegal to supply or import nitrous oxide for human consumption.

A warning letter sent to Mr Sabir says: "The fact the shop had balloons commonly used for consumption for laughing gas and charges where outside the shop and charges were also stored under the counter of the shop may indicate that the charges were not being sold for legitimate purposes i.e. to a restaurant for cream chargers, but to members of the public intending to get “high” on the drug."

Mohammed Sabir was convicted at Newport Magistrates' Court on April 9 this year of "providing unauthorised licence activities" and "selling alcohol after hours" at the store on July 8 and 15, 2017.

The application argues the premises' history demonstrates a "brazen disregard" to both conditions and hours attached to the premises licence and the licensing objectives.

It says enforcement activities undertaken "evidence the poor management of the premises by Mr Afran Sabir, his lack of control in respect of the premises licence and continued failure to ensure full compliance with the premises licence."

"It is felt appropriate that Mr Arfan Sabir the DPS is removed from the premises licence," the application says.

Any mitigation from Mr Sabir will also be considered at the meeting.
