A DRUNKEN teenager who attacked and racially abused a man outside his own home has been locked up for six weeks.

Kieran MacNeal, 18, kicked over the victim's bin, prompting the man to go outside to investigate.

The defendant then subjected him to a torrent of offensive remarks and kicked him, leaving him with pain to his shin.

MacNeal, who has a record for violence, had been freed from custody a few weeks before the early hours incident, and was on licence, Burnley Crown Court was told.

MacNeal, of Tarbert Crescent, Blackburn, had admitted the racially aggravated assault, which took place on February 17, and had been committed for sentence by magistrates.

Claire Thomas, defending, said he was unable to remember most of what happened.

He was drunk, he had been assaulted and, after he was taken to the police station, he was taken to hospital because of his injuries.

He had drunk very little alcohol since his release but, on the day of the offence, he had bumped into someone he met in custody and things had spiralled out of control from there, she said.

Miss Thomas said the defendant was sorry and ashamed of the language he used. He would not describe himself as a racist.

Miss Thomas said: “He was making good progress. He is gutted at the situation he finds himself in. This offence will have far more serious consequences for him than it would for others.”

Sentencing, Recorder Abigail Hudson told the defendant it was fortunate the victim did not suffer more serious injury.

She said: “You are not yet 19 and you have already amassed a record of unlawful violence.

“You were only released from custody in December, three months before your arrest for this.”

The judge said MacNeal appeared to be motivated to change and the assault was clearly unplanned, but it was demonstration he had not learned from the past.
